2、竞争，利于建筑质量的提高，更利于我国建筑市场的蓬勃发展。然而通过对比国内外的招投标制度，发现由于我国特有的经济发展模式以及建筑工程的特殊性导致了我国的招投标制度存在着很多不规范之处， 而且相关部门的监管力度也不到位。由此在建筑工程项目的招投标活动中产生了诸多问题，例如规避招标，围标串标等现象几乎成了行业市场内的“潜规则”，一些投资主体和承包方受高额的利益驱使，不惜违反法律，其中不乏政府机构。这些都是普遍存在的不规范的问题。由于这些现象直接影响了招投标的公平公正性，阻碍了公平竞争的市场秩序形成，因此，本次论文我以工程招投标规范化作为论题进行研究。本文中首先简要的介绍了招投标的起源与发展过程，以及

3、招投标的基本概念。其次，简要介绍了我国目前的建筑工程市场的现状，结合招投标条例法以及政府采购法和相关案例来找出目前招投标过程中所存在的问题。最后，分析这些已经存在的问题是如何产生的，从政府的管理机制，国家的条例法规，双方投资主体心理，以及招投标运行机制等方面对该问题的产生进行深入剖析，研究并提出相关的解决方案，以达到规范运行机制，完善管理办法的目的，为我国的建筑工程市场招投标规范化早日实现献策出力。关键词：工程项目招投标；运行机制；管理机制；规范化AbstractThe contracting of construction project is pleted by bidding. Bidding is the most effective way for owners to choose the best contractor, no matter for government investment project or other kinds of project. Carrying o

5、ut construction project bidding can be beneficial to not only the healthy petition between the construction enterprises, but also the building quality and the development of the construction market in China.However, by paring the domestic and international bidding system, I find that resulting from

6、our unique mode of economic development and the particularly of the construction project, there exist many non-standard places, and the supervision of relevant departments is inadequate. Thus many problems appeared in the bidding of construction project, such as to avoid bidding, bid rigging and oth

7、er phenomena almost bee the “hidden rules” of the industry. Some investors and contractors driven by the high interest would rather break the law, among which many of them are government agencies. These are all the non-standard problems. Because these phenomena directly affect the fairness of biddin

8、g and hinder the formation of the market order of fair petition, I decide to do a research on the standardization of construction bidding. First, this study begins with a brief introduction of the origin and development process of bidding, as well as the basic concept of bidding.Second,I give an int

9、roduction of the current situation of the construction market,and bined with The Law on Bidding Regulation and The Law on Government Procurement I find out the problems in current bidding process.Third, by analyzing how these problems came into being, I study the origin of the problems from the gove

10、rnments management mechanisms, national legislation and regulations, the main bilateral investment psychology, and other aspects of the bidding operational mechanism. I put forward some solutions to achieve standardized operation mechanism, and improve management. I hope this study can show some lig

15、4 年开始施行招标投标制以来，为建立起公开、公平、公正的建筑市场做出了卓越的贡献。1999 年 8 月 30 日第九届全国人大常委会第十一次会议通过了中华人民共和国招标投标法，次年 1 月 1 日起正式实施，从此以后，为全面推行招投标规范化管理提供了法律依据和保障。但是，由于工程建设方面的法律法规仍然不够健全，对建筑单位及施工单位的监管力度十分有限，导致了工程项目的招投标环节依然存在着诸多问题：例如，招投标市场的秩序混乱、法律法规监管不严格、地方保护主义滋生、以及利用发包权力向承包方收受贿赂等。这些现象更是严重与招投标法中关于遵循公开、公平、公正和诚信原则的规定背道而驰。束缚了招投标机制的正常运行，严重阻碍了招投标制度的推广以及应用。因此，本论文选题为“工程项目招投标过程规范化研究”旨在通过对具体案例的分析，中华人民共和国招标投标法与政府采购法等一些相关法规文件的深刻理解，深入研究在招投标过程中产生的一些违纪、违法、不规范的现象，以积极提出解决方案，使我国的工程项目招投标管理更加规范化，科学化。基于上述分析，本人认为，在国内的建筑招投标工作中
